Defendant Green operated a tractor-trailer owned by his employer, S.E. Cooperative, on MO Hwy 51, just south of Puxico, MO.  When Green crested a hill, he saw a pickup stopped in his lane just a short distance away without any tail lights.  Green braked, skidded and jack knifed.  His unit crossed the center line and collided with plaintiff's on-coming vehicle.  The pickup left the scene.  Plaintiff's 81 year-old driver / husband died at the scene.  Plaintiff sustained 3 fractured fingers and a questionable aggravation of a previous knee injury.  We argued that the absence of tail lights on the pickup delayed Green's perception time and was a significant cause of the accident.
 
   
Last Demand: Before the trial, the demand was $5 million.  During the course of the trial, the demand was reduced to an eventual $ 950,000.
   
Last Offer:  $ 200,000
   
Verdict: $ 218,000 for the wrongful death of Aubrey "Dick" Mays and
$ 2,000 for the personal injury of Emogean Mays
